1. General Commercial Scope

Pratyaksh Pool Care supplies residential, commercial, and institutional swimming pool equipment, including circulation pumps, multi-media sand filters, underwater LED lighting, chemical sanitizers (such as TCCA 90%), ladders, overflow gratings, and pool maintenance accessories. All quotations, sales invoices, and technical consultations are subject to these Terms.

2. Quotations, Pricing & Payments

• Price Validity: Product prices displayed on the website or quoted in commercial estimates are subject to market adjustments, raw material price fluctuations, and availability. Written quotations remain valid for the period stated on the quotation document (typically 15 to 30 days).

• Taxes & Duties: Unless explicitly stated otherwise, prices are exclusive of applicable goods and services taxes (GST), local municipal levies, freight, insurance, and unloading fees, which will be itemized on final invoices.

• Payment Terms: Orders require payment settlement as agreed upon in writing (e.g., full advance payment, advance deposit with balance against transport bilti/dispatch, or defined commercial milestones).

• Order Acceptance: We reserve the right to decline or cancel orders due to catalog errors, stock depletion, or payment clearance discrepancies.

3. Shipping, Logistics & Delivery

• Freight & Dispatch: Goods are dispatched via third-party freight carriers, logistics operators, or courier services. Estimated dispatch and delivery dates are indicative and not guaranteed delivery deadlines.

• Transit Risk: Unless transit insurance is explicitly purchased and included in the invoice, goods travel at the buyer's risk once handed over to the carrier.

• Delivery Inspection: The buyer or designated consignee must inspect consignments upon receipt. Any visible packaging damage, seal tampering, or carton shortages must be recorded on the carrier’s delivery receipt (consignment note) and reported to Pratyaksh Pool Care within 48 hours of delivery.

4. Technical Specifications & Professional Installation

• System Sizing: Sizing suggestions, pump flow calculations, and filter media recommendations provided by our technical desk are based on information provided by the client. The buyer remains responsible for verifying site-specific hydraulic compatibility, piping head loss, and power availability.

• Installation Requirement: All mechanical, hydraulic, and electrical equipment—such as high-pressure pumps, multiport valves, electrical switchgear, underwater transformers, and chemical dispensers—must be installed and commissioned by certified pool contractors or licensed electricians.

• Plumbing & Electrical Codes: Installations must strictly follow national building codes and electrical safety regulations (including proper grounding and earth leakage circuit breaker protection).

5. Chemical Products & Safe Usage

• Potency & Storage: Chemical products—including TCCA 90% tablets/granules, pH balancers, and coagulants—are industrial-strength oxidizers and water treatment agents.

• Buyer Responsibility: Chemical handling, storage, and application are the sole responsibility of the purchaser. Products must be stored in dry, cool, well-ventilated areas away from acids, direct sunlight, and combustible materials.

• Misuse Disclaimer: Pratyaksh Pool Care accepts no liability for chemical overdosing, bather physiological irritation, bleached pool surfaces, or toxic gas reactions caused by improper mixing, lack of personal protective equipment (PPE), or off-label use.

6. Warranty Terms & Exclusions

• Manufacturer Warranty: Equipment is covered solely by the manufacturer’s limited warranty against inherent material and manufacturing defects for the specific period designated on the product documentation.

• Warranty Exclusions: Warranties do not cover failures, damages, or performance degradation resulting from:

  • Running pumps dry without prime or adequate water flow.

  • Electrical voltage fluctuations, power surges, or incorrect phase wiring.

  • Media channeling or bursting caused by excessive operating pressure or neglected backwashing.

  • Chemical corrosion, scale buildup, or pitting caused by improper pool water pH/alkalinity balance.

  • Unauthorized modifications, third-party repairs, or use of non-standard replacement parts.

  • Normal wear-and-tear components (such as O-rings, mechanical shaft seals, light gaskets, and filter laterals).

7. Returns, Replacements & Cancellations

• Custom & Chemical Goods: Chemical products (due to safety and storage contamination risks) and custom-fabricated items (such as customized stainless steel rails or cut-to-length overflow gratings) are non-returnable and non-refundable once dispatched.

• Defective Equipment: In the event of an out-of-box manufacturing defect, the buyer must notify us within 7 days of delivery. Upon physical inspection and technical evaluation by our team, authorized replacements or repairs will be processed in accordance with the product’s warranty terms.

• Restocking Fees: Authorized returns for standard non-defective, unused hardware in original factory packaging may be subject to a restocking fee (up to 15–20%) plus return freight charges borne by the customer.

8. Intellectual Property

10. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of India. Any legal disputes, claims, or proceedings arising out of or related to these Terms, purchases, or services shall fall under the exclusive jurisdiction of the competent courts having local territorial jurisdiction over the registered business operations of Pratyaksh Pool Care.

11. Amendments to Terms
